JAN JOHNSON GRADUATED FROM HIGH SCHOOL IN HERTFORDSHIRE, ENGLAND, FROM UNIVERSITY AT TROY STATE IN ALABAMA, AND FROM LAW SCHOOL AT THE UNIVERSITY OF PUERTO RICO. HE RETIRED WITH THE RANK OF BRIGADIER GENERAL, AS COMMANDING OFFICER OF THE PUERTO RICO AIR NATIONAL GUARD WHERE HE FLEW F-16 FIGHTER AIRCRAFT UNTIL HIS RETIREMENT IN 1995.
MR JOHNSON WAS APPOINTED AS THE CHAPTER 13 TRUSTEE FOR THE DISTRICT OF PUERTO RICO IN 1989, WHERE HE WAS RESPONSIBLE FOR OVER 25,000 CASES. HE WAS ALSO APPOINTED AS TRUSTEE FOR THE US VIRGIN ISLANDS IN 1995. HE MOVED TO SACRAMENTO IN NOVEMBER 1998, AND WAS APPOINTED AS CHAPTER 13 TRUSTEE FOR THE EASTERN DISTRICT OF CALIFORNIA, SACRAMENTO DIVISION IN MARCH 1999, AND INTERIM TRUSTEE FOR RENO, NEVADA IN SEPTEMBER 1999. HE IS LICENSED TO PRACTICE LAW IN THE COMMONWEALTH OF PUERTO RICO, THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF PUERTO RICO, AND THE FIRST CIRCUIT COURT OF APPEALS.
HE IS A PAST PRESIDENT OF THE NATIONAL ASSOCIATION OF CHAPTER 13 TRUSTEES (NACTT) , AND OF THE SACRAMENTO VALLEY BANKRUPTCY FORUM AND IS ACTIVE IN PROMOTING CONTINUED EDUCATION FOR LOCAL PRACTITIONEERS. HE IS A FOUNDING DIRECTOR OF THE NACTT ACADEMY, DEDICATED TO THE FURTHERANCE OF KNOWLEDGE OF ALL PRACTITIONERS. |

The Legal Department is responsible for the handling of all cases prior to confirmation and some specific motions filed after confirmation. Following is a list of duties performed by the Legal Department. If you have any questions regarding an opposition or a motion filed by the Trustee's office please contact the person whose name appears on the Proof of Service.
The last day to discuss a matter on a Law & Motion calendar is two business days prior to the scheduled hearing. The legal department CANNOT discuss any matters after the deadline.
Purview:
· Review of petition, schedules and supporting documents for the §341 meeting of creditors. · Preparation of Trustee's motions stemming from the §341 meeting of creditors. · Review of pre-confirmation amendments. · Processing orders confirming or orders modifying. · Processing all incoming mail and review of all motions for relief, creditors' objections to confirmation stipulations, civil minute orders, motions to set aside order dismissing. · Review of motions to confirm or motions to modify. · Review of motions for attorney's fees. · Review of motions to sell property, motions to incur debt, motions to refinance. * · Adversaries or appeals.

Purview:
CLAIMS PROCESSING
· Review and process all incoming claims at Court. Complete all claim adjustments. · Calculate interest that should have paid on claims subsequently and complete correction forms. · Input claim changes from Amendments. · File all Trustees' Objections and allowances of claims (follow up and process orders. · Receive Notices of Objections to claims (debtor's), docket, place holds, follow up and process Orders. · Answer all special questions regarding claims. · Retrieve funds from creditors on overpaid claims. · Process all outgoing letters specifically related to claims. · Review claims and make necessary changes upon receipt of Order Confirming Plan, Motions to Value, Motions to Avoid. Process incoming Motions to Value and Motions to Avoid. · Prepare, audit for, and process Notice of Filed Claims. · Run and review 120-Day Not Provided For Report.
MISCELLANEOUS
· Creditor and attorney address changes. · Process Requests for Special Notice. · Receive, review and respond to creditor status requests and correspondence. · Receive, review and take appropriate action on Certificates of Title.

Purview:
CLOSE CASES
· Receive all endorsed orders dismissing or converting. · Audit and close all cases to Trustee's system.
FINAL REPORTS
· Process and file with the Bankruptcy Court all Final Reports and Orders Approving Final Report, as well as Order Closing Case.
